Obtaining a Complying Development Certificate is the simplest way to get Council approval for a new house, extension, pool, awning, carport, garage, demolition or fencing. Complying development is development that meets predetermined standards contained within the NSW Housing Code, which commenced on 27 February 2009. Copies of the Housing Code and further information is available via the Department of Planning web site at www.planning.nsw.gov.au/housingcode .
For a period of 12 months, applicants can choose to have the Complying Development standards under State Environmental Planning Policy 60 - Exempt and Complying Development (SEPP60) used to assess their application instead of the NSW Housing Code. After 27 February 2010 applications can only be assessed under the NSW Housing Code.
If an application meets all the standards under the NSW Housing Code or SEPP 60, a complying development certificate can be issued instead of a development consent and construction certificate. The majority of complete complying development certificate applications are processed within 10 days. It is important to note that rural dwellings and mining camps require Council approval. The Housing Code applies to rural and urban zones while overiding the provisions of Interim Development Order No 1 - Shire of Walgett which previously allowed rural dwellings and mining camps to be established without approval from Council (just as SEPP60 did when it commenced on 3 March 2000). The Housing Code also supersedes the obsolete "Camps Guidelines" (commonly known as the mining camp 'green book'). A complying development certificate application form can be downloaded below.
