Local Approvals Policy

The Walgett Shire Council Local Approvals Policy specifies criteria that Council must consider when determining whether or not to grant approval for a particular activity under Section 68 of the Local Government Act 1993, as well as the circumstances in which a person is not required to obtain a particular approval from Council.
'Approval' means approval of an activity that is listed in the Table accompanying Section 68 of the Local Government Act 1993. This should not be confused with a requirement for a 'Development Consent' issued in accordance with the provisions of the Environmental Planning and Assessment Act 1979.
While certain activities may be exempt from 'approval', they may still require 'development consent'. If you are uncertain whether you require approval for a proposed development or an activity, then contact Council's Planning and Regulation staff.
At a meeting held on 28 April 2009, Walgett Shire Council resolved to place the Draft Walgett Shire Council Local Approvals Policy on exhibition and invite written submissions from the public regarding the draft policy. The policy is on public exhibition from 22 May 2009 until 3 July 2009. Council will consider all submissions received by the close of business on 3 July 2009.
Key changes proposed in the draft policy are the addition of exemption criteria for operating systems of sewage management, fuel heating devices (wood heaters) and amusement devices. Recent legislative changes have prompted the deletion of references to places of public entertainment and temporary structres, which are now dealt with under the Environmental Planning and Assessment Act 1979 and the State Environmental Planning Policy (Temporary Structures and Places of Public Entertainment) 2007.
